The directory agreement

This is the agreement you accept when you join the Discover Art Therapy directory of online art therapists.
Please read it before you pay. If anything is unclear, email [email protected]

In plain words

  • You're independent. You work for yourself. Being in the directory doesn't make you part of Discover Art Therapy, and Discover Art Therapy isn't responsible for your work with clients.
  • Your badges are honest. If you tick a care badge, you're telling visitors you have that training.
  • Private information stays private. Your registration number and agreement ticks are only seen by me. Anything you share about your own background shows only if you choose.
  • Client art stays out. You won't put client artwork, or anything that could identify a client, on your card or in anything you link.
  • Payment and your card. Your card is live while you have paid time left, and hidden when it runs out. It's never deleted. Your founding price stays the same for as long as you remain a member. If you cancel and later rejoin, you pay the price that applies then.
  • Verified. I read every new card, check your photo against your website and what I can find about you online, and ask for your registration number if you have one. If I need to clarify something, I may ask to see a photo of your diploma. It isn't an endorsement, and it doesn't guarantee your training, registration or insurance. I can ask for changes, and I can take a card down if something isn't honest or safe.
  • My Instagram. Once a month, I'll share the headshots of the therapists in the directory on my Instagram.

The full agreement

1. What the directory is. Discover Art Therapy creates and hosts a directory page where independent professionals can list themselves so that people can find them. It is a listing service. Discover Art Therapy does not provide therapy or counselling, does not employ or supervise the people listed, and does not refer clients as a clinical service.

2. You are independent, with no affiliation. You are an independent professional. You are not an employee, contractor, agent, partner or representative of Discover Art Therapy or Ashleigh Gureckas. Your listing does not mean you are part of Discover Art Therapy, and you will not say or suggest that you are. You may use the "Verified" badge only as it is shown on your card, and only while your card is live.

3. Your services are your own. You are solely responsible for your services, your clients, your fees, your records, your insurance, your advertising and your compliance with the laws, professional codes and regulators that apply to you where you practise and where your clients live. You confirm that you hold the credentials, registrations and licences you list, that you are allowed to use the title you list where you practise, and that you remove yourself promptly if any of them lapse, are suspended or are made conditional.

4. Be accurate and honest. Everything on your card must be true and not misleading. In particular:

  • Care badges (such as "2SLGBTQIA+ affirming care", "Trauma-informed care", "Neurodiversity-affirming care" and "Racial trauma informed care") are your own statements about the care you provide. Discover Art Therapy does not check them. You may only tick one if you have the training, experience and ongoing practice to back it up, and you must stay truthful about it. Discover Art Therapy may remove a badge or your card if it learns a badge is not true.
  • What the "Verified" badge means is limited to: Ashleigh read your card, checked that the photo on it matches what she can find about you on your website and online, and asked for your registration or licence number if you have one. If she needs to clarify something, she may ask you for a photo of your diploma. It is not an endorsement of you or your work, it is not a guarantee of your skill or safety, it does not create a duty of care, it is not a promise about anyone's results, and it does not promise that your training, registration, licence or insurance are current or valid.
  • Who can list. Art therapists, including students and art therapists in training. If you are in training, you tick the box that adds an "In training" tag to your card, and you tell us where you are training.
  • Client artwork stays out. You will not put client artwork, or anything that could identify a client, on your card or in any photo or video you link.
  • You will not promise cures, results or outcomes.
  • Accessibility of your content. You will write a short plain description for every photo, and turn on captions for any video you link, so that people who are blind, low-vision, deaf or hard of hearing can use your card. Discover Art Therapy builds the directory to accessibility standards but cannot check what each therapist adds.

5. No liability for sessions. Discover Art Therapy is not responsible for, and has no liability for, any session, advice, treatment, service or product you provide, or for anything that happens between you and a client or any visitor to the directory. As far as the law allows, you will cover Discover Art Therapy and Ashleigh Gureckas for claims, costs and losses that come from your services, your listing or your breach of this agreement.

6. Sensitive personal information.

  • What we collect from you. (a) Public on your card, only if you choose to fill it in: your name, photos, credentials, place, contact buttons, what you help with, the care badges you tick, and, separately and optionally, whether you are BIPOC, 2SLGBTQIA+ and/or neurodivergent, with a few words in your own voice. (b) Private, seen only by Ashleigh: your registration or licence number and any link you give to a public register, your private notes to Ashleigh, and your email address and payment record from Kajabi.
  • Your background information is optional and separate. We use it only to show the badge you chose and to let visitors filter for it. If you leave it blank, nothing about it is shown anywhere and you are never matched or ranked on it. We never describe someone with no badge as "not" any background. We do not use it for advertising, we do not sell it, and we do not share it except with the service providers who run the directory for us (for example Kajabi, the service that stores the cards and photos, and email delivery), under their own privacy commitments.
  • Consent. You give explicit, separate consent, by ticking the box on the form, before any background information is shown. You can withdraw it at any time by removing it from your card, and it stops showing at once. Copies held by search engines, browsers or other people may take longer to disappear and are outside our control.
  • Public means public. Anything shown on your card can be read, copied and saved by anyone on the internet. Do not put anything on your card you are not comfortable having public.
  • When you leave or stop paying. Your card is switched off and hidden at the end of the period you paid for. It is kept, not deleted, so you can return easily but only within 1 yr (12 months). You can ask for earlier deletion at any time, and we will delete it within 30 days. Private information is kept only as long as needed to run the directory and meet legal duties.
  • Your rights. You can ask to see, correct or delete your information, and you can complain to the Office of the Information and Privacy Commissioner for BC.
  • Clients. Discover Art Therapy does not receive, store or see any information about your clients. Anything a visitor sends you goes directly to you and is your responsibility under your own privacy duties.

7. Not a crisis or emergency service. The directory is not a crisis service. You will not rely on it to receive urgent client contacts, and you will follow the crisis and safety duties of your own profession.

8. Your content. You own your photos and words. You give Discover Art Therapy permission to display them on the directory for as long as your card is live (and to keep them while it is hidden). You also give Discover Art Therapy permission to share your headshot on its social media accounts, for example once a month, to point people to the directory, for as long as your card is live. You confirm you have the right to use every photo, and that people shown in your art or photos agreed. You will write a short plain description for each photo so it can be read by a screen reader.

9. Payment, switching off and returning. Membership is monthly or yearly through Kajabi. The founding price stays the same for as long as you remain a member. If you cancel and later rejoin, you pay the price that applies at that time. Your card stays live until the end of the period you have paid for, unless an explicit request for earlier deletion is made. Cancelling, pausing or a failed payment all mean no new payment arrives, so your card switches off when the paid time runs out. It comes back when you pay again.

10. No Refunds. No refunds for previous months are available, and no partial refunds for the duration of an annual membership are available.

11. Review, changes and removal. Ashleigh reviews each new card before it goes live. After that, your edits go live straight away, and the last version is kept so a slip can be undone. Discover Art Therapy may refuse, hide or remove a card, with or without a refund if information is untrue, or this agreement is broken.

12. Complaints about therapists. Discover Art Therapy is not a regulator and cannot investigate a therapist's practice. If someone complains, Ashleigh may pass it to you, may hide your card while she contacts you, and will tell the person to contact your regulator where there is one.

13. Changes, law and disputes. Discover Art Therapy may update this agreement and it will always be available in your member portal.
